PROCEDURES AND PRINCIPLES FOR APPLICATION TO THE DATA CONTROLLER UNDER LAW NO. 6698

As Malkan Makina, we manage the processes for exercising your rights regarding your personal data in accordance with Article 13 of the Personal Data Protection Law No. 6698 and the Communiqué on the Procedures and Principles of Application to the Data Controller published in the Official Gazette dated 10.03.2018 and numbered 30356, within the framework of the applicable legislation in force. 1. Accepted Application Channels

  • Written: By submitting a wet-signed petition in person or by post to Karayolları Mah. 559. Sok. No:16 Gaziosmanpaşa / ISTANBUL.
  • Registered Electronic Mail (KEP): Through our registered electronic mail address malkanmakina@hs06.kep.tr.
  • Registered E-Mail: Via the electronic mail address previously notified to the data controller and registered in our system, to info@malkan.com.tr.
  • Other Electronic Methods: By sending to info@malkan.com.tr signed with a secure electronic signature or mobile signature.

2. Mandatory Elements of the Application

Pursuant to the Communiqué, the following information must be included in the application:

  • Name, surname and signature in written applications
  • For Turkish citizens, Turkish ID number; for foreigners, nationality, passport number or identification number, if any
  • Residential or business address for notification
  • If available, e-mail address, telephone and fax number for notification purposes
  • Subject of the request

3. Evaluation Period and Procedure

Your requests shall be responded to free of charge within a maximum of thirty (30) days from the date the application is received by the data controller. The application may be accepted or rejected with justification. If accepted, the necessary action shall be taken and you shall be informed in writing or electronically.

If the response requires an additional cost, the fee determined by the Board may be charged.

4. Right to Lodge a Complaint with the Board

Pursuant to Article 14 of the Law; in cases where your application is rejected, the response is deemed insufficient, or no response is provided within the prescribed period:

You have the right to file a complaint with the Personal Data Protection Board within 30 days from the date you learn of the response and in any case within 60 days from the date of application.

5. Your Rights Under Article 11 of the Law

• To learn whether your personal data is processed
• To request information if your personal data has been processed
• To learn the purpose of processing and whether it is used in accordance with its purpose
• To know the third parties to whom your personal data is transferred domestically or abroad
• To request correction if your personal data is incomplete or incorrectly processed
• Pursuant to Article 7 of the Law, to request deletion or destruction of your personal data
• To request notification of correction, deletion or destruction to third parties to whom personal data has been transferred
• To object to the occurrence of a result against you by analyzing processed data exclusively through automated systems
• To request compensation for damages in case of loss

6. Important Reminders and Security

In order to ensure data security, identity verification is required. For the prompt and proper processing of your application, please use the Data Subject Application Form available on our website. We reserve the right to request additional documents for identity verification. The requested additional information and documents shall be processed solely for the purpose of identity verification.
