Laser Cutting Service Terms

We cut your sheet; your drawing stays yours.

These terms apply to the sheet-metal laser cutting service offered by Malkan Makina Sanayi ve Ticaret A.Ş. (the “Company”) to its customers. Matters not covered by these terms are governed by the General Terms of Sale and Delivery.

A correct offer starts with the correct file.

• An offer requires a technical drawing file (e.g. DXF, DWG) together with the material type, thickness and quantity.
• The offer is prepared on the basis of the drawing and information sent; the customer is responsible for dimensional and geometric errors in the drawing.
• The contract is formed when the customer confirms the offer in writing and the Company confirms the work order.

Your drawing is used only for your job.

• The drawings you send are used only to prepare the offer and to produce the parts you order.
• Your drawings are not shared with third parties, are not used for any other job and can be seen only by the employees assigned to that job.
• Files that do not result in an order are deleted at your request; records of jobs that result in an order are kept for the period required by commercial legislation.

The nature of the laser is written in the offer.

• Material may be supplied by the Company or provided by the customer; the customer is responsible for the quality and suitability of the material it provides.
• Dimensional tolerances are stated in the offer.
• Fine burrs on the cut edge, heat discolouration and the micro-joints that hold the part in place are not defects unless otherwise agreed in writing.

What is written in the offer applies.

• Price, payment terms and delivery time are stated in the offer.
• Unless otherwise agreed, parts are delivered at the Company’s premises; for shipments by cargo, risk passes to the customer when the parts are handed over to the carrier.

Measure on delivery, report problems at once.

The customer inspects the parts without delay upon receipt and, if it believes there is a defect, notifies the Company in writing.

Merchant customers notify obvious defects within two days of delivery, defects detectable by inspection within eight days, and hidden defects as soon as they are discovered (Article 23 of Turkish Commercial Code No. 6102). If a defect is not notified in time, the parts are deemed accepted.

For customers who are not merchants (consumers), the mandatory provisions of the Turkish Code of Obligations and of consumer legislation on notice of defects and on rights arising from defects apply; these terms do not limit those rights.

The drawing’s rights are yours; the cut is our responsibility.

• The customer confirms that it holds the necessary rights to the drawing it sends and that the drawing does not infringe the rights of third parties.
• The Company cuts the parts in accordance with the approved drawing and the tolerances in the offer; it is not liable for errors arising from the drawing or from material provided by the customer.
• Except in cases of intent and gross negligence, the Company’s liability is limited to the price of the job concerned.

The path in a dispute is clear.

These terms are governed by Turkish law; in disputes, subject to the provisions on mandatory mediation as a precondition to litigation, the Istanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction.
