ACCEPTED APPLICATION CHANNELS AND APPLICATION LANGUAGE
Applications should principally be submitted in Turkish in accordance with the Law and the Communiqué.
Applications may be submitted through the following channels:
- In writing with a wet-signed petition delivered personally or by post;
- Via Registered Electronic Mail (KEP);
- Through the e-mail address previously notified to and registered by MALKAN;
- Via secure electronic signature or mobile signature.
MANDATORY INFORMATION REQUIRED IN APPLICATIONS
Applications must include:
- Name and surname,
- Signature for written applications,
- Turkish Identification Number for Turkish citizens,
- Nationality, passport number or identification number (if any) for foreign nationals,
- Residential or business address for notification,
- E-mail address, telephone and fax number (if any),
- Subject matter of the request.
Supporting information and documents should also be attached where relevant.
EVALUATION PERIOD, PROCEDURE AND FEES
Applications shall be finalized free of charge as soon as possible and no later than thirty (30) days following receipt by MALKAN.
The application may be accepted or rejected with a justified explanation.
Responses shall be provided in writing or electronically.
If the process requires an additional cost, a fee may be charged in accordance with the tariff determined by the Personal Data Protection Board and applicable at the relevant time.
RIGHT TO LODGE A COMPLAINT WITH THE BOARD
Pursuant to Article 14 of the Law, if your application is rejected, if the response is considered insufficient, or if no response is provided within the legal period, you may lodge a complaint with the Personal Data Protection Board within thirty (30) days from the date you learn of the response and, in any event, within sixty (60) days from the date of application, provided that you have first exhausted the application procedure before MALKAN.
YOUR RIGHTS UNDER ARTICLE 11 OF THE LAW
You have the right to:
- Learn whether your personal data are processed,
- Request information if your personal data have been processed,
- Learn the purpose of processing and whether such data are used in accordance with that purpose,
- Be informed of third parties to whom personal data are transferred domestically or abroad,
- Request rectification of incomplete or inaccurate personal data,
- Request deletion or destruction of personal data under Article 7 of the Law,
- Request notification of rectification, deletion or destruction to third parties to whom data have been transferred,
- Object to outcomes against you arising from analysis exclusively through automated systems,
- Claim compensation for damages arising from unlawful processing.
IMPORTANT REMINDERS AND DATA SECURITY
- Identity verification may be requested where necessary to confirm that the application has been submitted by the relevant data subject.
- For faster and more efficient processing, use of the Data Subject Application Form available on our website is recommended.
- Applications containing the mandatory elements required under the Law and the Communiqué shall be evaluated even if the form is not used.
- Any additional information and documents requested for identity verification purposes shall be processed solely for that purpose.
Procedures and Principles of Application to the Data Controller have been prepared in accordance with the Law on the Protection of Personal Data No. 6698 and the relevant legislation in force.
